Terms and Conditions
In these terms and conditions, you will find information about the provisions and conditions applicable to the services of SeaScape Sailing, hereinafter referred to as ‘SeaScape Sailing’.
Conditions for both shareboat and private charter reservations
- We will hold an option for 48 hours whilst you decide if you would like to confirm a booking. After this time, the option will cancel automatically unless otherwise agreed.
- After confirmation within 48 hours, you will receive an invoice to make the stated payment within 3 working days.
- A reservation is guaranteed when paid in full.
- In the event of incorrect rates or availability, obvious errors and mistakes (including misprints, mistypes and zero rates) are not binding; E.g. if a reservation for one person costs an average rate of €1.000 throughout the year, a rate of €100 qualifies as an obvious mistake and the reservation won’t be honored.
Additional conditions for shareboat reservations specifically (applicable to reservations for separate berches on a shareboat)
- We ask payment of 100% of the booking fee at the moment of making the booking.
- When the full amount of the reservation is not paid within the stated payment term, your reservation will be cancelled.
- The minimum group size of shareboat trips is 4 persons. If SeaScape Sailing doesn’t reach this minimum group size before 30 days before departure, we reserve the right to cancel the entire trip. In that case you will receive a full refund. SeaScape Sailing cannot be held responsible for any other travel costs incurred, nor changes in personal arrangements, etc.
Additional conditions for private charter reservations specifically (applicable to reservation for use of the entire boat)
- We ask a prepayment 25% at the moment of making the booking. The remaining 75% is required to be paid at least 90 days before departure.
- When the full amount of the reservation is not paid within 90 days before departure, your reservation will be cancelled.
Booking cancellation and changes
- For cancellation of your reservation, the following conditions and cancellation fees apply:
- Cancellations 6 months or more before departure: €100 admin fee.
- Cancellations between 3-6 months before departure: the customer is obliged to pay 25% of the charter fee.
- Cancellations between 2-3 months before departure: the customer is obliged to pay 50% of the charter fee.
- Cancellations between 1-2 months before departure: the customer is obliged to pay 80% of the charter fee.
- Cancellations 1 month or less before departure: the customer is obliged to pay 100% of the charter fee.
- If you have already paid for your reservation, we will refund the prepaid amount in accordance with the cancellation policy to the credit card or bank account from which the booking was paid.
- Should unavoidable circumstances arise which force the cancellation of your trip, you will not hold SeaScape Sailing responsible for any other associated travel costs nor changes in your personal plans.
Your trip with us
- Boarding starts at 09:00 for both shareboat and private charters.
- Boarding time for private charters can be slightly altered. As you’re chartering the yacht all for yourselves we can work around your schedule a little more. For example if you’re flying into Kos on the morning of departure, and will be a little late, no problem at all. Just keep in touch and let us know.
- Our embarkation time is 9:00h. You are kindly requested to vacate the boat.
- Large and/or hard suitcases cannot be taken on board, see FAQ for more info. For such suitcases, there is a luggage storage facility in the reception of Kos Marina available for a small fee and at your own cost. Kindly keep in mind that SeaScape Sailing is not liable for any damages or theft of luggage.
- The lead guest’s details must be entered during check-in, including address, date of birth, and type and number of identity document. All passengers must provide their full names and passport numbers. The form will be sent to you to fill in after booking. Passport numbers are mandatory for the passenger crew list which is a legal requirement on board and signed off for each charter by the Port Police.
- With regard to the personal data provided during the check-in process, we act in full compliance with the laws in force regarding the protection of personal data. Our Privacy Policy is available on the SeaScape Sailing website.
- By booking a trip with SeaScape Sailing, guests agree to adhere to our boat etiquette, instructions from SeaScape staff, and conduct themselves in a manner that ensures the comfort and safety of all guests and staff. Failure to do so, or when a guest’s behaviour is deemed to be causing distress, damage, danger or annoyance to other clients, may result in immediate termination of your trip, being asked to leave the boat, and, if necessary, involvement of the authorities. Upon such termination, SeaScape Sailing’s responsibility for your trip ceases and shall not be liable for any other costs incurred.
- Should any issues arise during the trip about which you have concerns, you will inform a SeaScape team member as soon as practically possible. You agree there will be no post-trip discussions of issues which were not brought to SeaScape Sailing’s attention at the time.
Safety on board
- You will take as final the skipper’s decision on all matters concerning the safety and well-being of everyone on board.
- You assume all risks involved with this vacation, whether onboard, on shore, swimming, scuba diving, cycling, motorbiking, snorkeling or partaking in any other activities whatsoever. Guests will not hold either SeaScape Sailing, its employees or associates liable for any injury, illness or damage that they incur, either on the boat, or as a result of other activities or tours or land-based excursions suggested by SeaScape Sailing crew.
- You have sufficient physical agility and balance to navigate narrow gangplanks, dinghies, etc, and actively partake in other typical sailboat activities.
- You have no medical, personal or other conditions of which you am aware which may affect your ability to fully participate in this vacation as described in the trip notes. If any such issues or concerns exist or may exist, you will inform SeaScape Sailing in writing at the earliest possible opportunity.
Pet Policy
- Pets are not allowed on board, except for pets owned by the owner of SeaScape Sailing or crew.
Smoking and drugs policy
- We want to ensure a pleasant stay for all our guests. Therefore, please note that our boat is a smoke-free zone. Smoking is not permitted below deck, though may be permitted on the stern of the yacht only at times when the wind blows the smoke away from other passengers and away from the boat.
- To maintain a safe and comfortable environment, we strictly prohibit the use, possession, and sale of drugs on our boats. Violators will be subject to a fine of €150, and the local authorities will be informed.
Damage or loss of personal property
- SeaScape Sailing is not responsible for any direct or indirect damage arising from guest actions or the use of our services. This includes incidents such as fire, theft, or unlawful acts. We also disclaim liability for damage to guests’ personal belongings or caused by third parties.
- Should a guest cause damage to the boat, the reservation holder is responsible for associated costs. This includes any necessary cleaning for excessive mess or missing items from the boat. SeaScape Sailing reserves the right to charge such costs to your booking, or credit card.
- Any damage to the boat should be reported to the skipper at the earliest convenience.
Force majeure
- If SeaScape Sailing is unable to deliver specific services or fulfill part or all of its agreement with the guest due to unforeseen events, SeaScape Sailing will not be held responsible for any resulting damages. In such cases, they are also not required to offer any form of compensation.
- These unforeseen events, or force majeure, are circumstances beyond the control of SeaScape Sailing or the SeaScape crew, for which they are not to blame or liable. Events that qualify as force majeure include pandemics, unsuitable weather, wars or war threats, strikes, workplace occupations, social disruptions, riots, employee illnesses, acts of terrorism, fires, natural or other types of disasters, interruptions in utilities such as gas, electricity, or water, and government actions that prevent the provision of sailing services.
- In such situations, SeaScape Sailing has the right to suspend its obligations or cancel the reservation with the guest.
Preserving the General Terms & Conditions
- No aspect of these Terms & Conditions will undermine the obligatory provisions concerning consumers. If any part of these T&C is found to be invalid or unenforceable, the remaining sections will still be effective. Any invalid or unenforceable provision will be substituted and aligned with the intended purpose of the original clause as closely as possible.
Modifying the General Terms & Conditions
- SeaScape Sailing retains the right to change these Terms & Conditions without prior notification. Since updates to the Terms & Conditions will appear on the SeaScape website, you should review the current version of the Terms & Conditions before your trip.
Governing Law and Jurisdiction
- Unless bound by obligatory national or international legislation, Greek law governs these Terms & Conditions and the agreement between SeaScape Sailing and the guest. Unless mandatory national or international law imposes otherwise, any disputes related to or stemming from these Terms & Conditions and/or the agreement between SeaScape Sailing and the guest, shall fall under the exclusive jurisdiction of the competent court in Greece.
